These terms govern The Plan Credit offer made available by Barndo Kit Company LLC ("Barndo Kit Co," "we," "us," or "our"). By purchasing a floor plan from Barndo Kit Co, you agree to these terms.

1. How the Credit Works

When you purchase an eligible floor plan through barndokitco.com and subsequently purchase a Freedom Package from Barndo Kit Co, we will apply a credit equal to 100% of the amount you paid for that floor plan against the purchase price of the corresponding Freedom Package. The maximum credit applied per Freedom Package order is $5,000.

The credit is applied automatically at the time of your Freedom Package purchase. No code, coupon, or separate claim is required. Credits are tied to your account and the plan purchase associated with it.

2. Eligible Plans

The Plan Credit applies to any floor plan purchased directly through Barndo Kit Co, including base plan prices and any customization fees paid to Barndo Kit Co for modifications to that plan. Plans purchased through third-party websites or vendors are not eligible, even if those plans are later used in connection with a Freedom Package order.

3. Credit Cap

The maximum credit per Freedom Package order is $5,000, regardless of the total amount paid for the associated floor plan and any customizations. Amounts paid in excess of $5,000 are not carried over, refunded, or applied to any other purchase.

4. Multiple Plan Purchases

Customers who purchase more than one floor plan from Barndo Kit Co are eligible to receive a separate credit for each plan, applied individually to the Freedom Package order for which that plan is used. Credits do not carry over between Freedom Package orders. A credit is earned only for a plan that results in a corresponding Freedom Package purchase. Plans purchased but not used as the basis for a Freedom Package order do not generate a credit.

Example: A customer purchases three floor plans. They proceed with Freedom Package orders for two of those plans. They receive a credit for each of the two plans used, up to $5,000 per order. The third plan, for which no Freedom Package is ordered, generates no credit.

5. Combination with Other Offers

The Plan Credit may be combined with other discounts, promotions, or offers made available by Barndo Kit Co at the time of your Freedom Package purchase, unless otherwise stated in the terms of a specific promotion.

6. No Refunds on Floor Plans

All floor plan purchases are final. Because floor plans are delivered digitally, no refunds are issued once a plan has been received. A refunded or charged-back plan purchase voids any associated Plan Credit.

7. Non-Transferability

The Plan Credit belongs to the customer account under which the floor plan was purchased. Credits are non-transferable and may not be sold, assigned, or applied to purchases made under a different account or by a different purchaser.

8. Modification and Discontinuation

Barndo Kit Co reserves the right to modify, suspend, or discontinue The Plan Credit offer at any time. Any such change applies only to floor plan purchases made after the effective date of the change. Customers who purchased eligible floor plans prior to a modification or discontinuation retain the right to apply their credit to a future Freedom Package purchase under the terms in effect at the time of their plan purchase.

9. Governing Law

These terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions.

10. Dispute Resolution

Informal Resolution First: Before initiating any formal proceeding, both parties agree to attempt to resolve any dispute informally. The party raising the dispute must notify the other in writing describing the issue and the resolution sought. Both parties will make a good-faith effort to resolve the matter within 30 days of that notice.

Binding Arbitration: If the dispute is not resolved informally, it will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in Nashville, Tennessee, or by remote proceeding if both parties agree. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Small Claims Exception: Either party may bring an individual claim in a small claims court of competent jurisdiction instead of arbitration, provided the claim qualifies for that court's jurisdiction.

No Class Actions: All disputes must be brought on an individual basis. You may not bring or participate in any class action, class arbitration, or consolidated proceeding against Barndo Kit Co related to The Plan Credit.

Costs: Each party bears its own attorneys' fees and arbitration costs, except where the arbitrator determines that a claim or defense was frivolous or brought in bad faith, in which case the arbitrator may award fees and costs to the prevailing party.

11. Entire Agreement

These terms, together with any other terms and policies posted on barndokitco.com, constitute the entire agreement between you and Barndo Kit Co regarding The Plan Credit. If any provision of these terms is found unenforceable, the remaining provisions continue in full force.
