Terms of service

TERMS OF SERVICE

Last updated: October 6, 2026

These Terms of Service (“Terms”) govern your access to and use of the Barndo Kit Co website, products, services, plans, materials, communications, and related offerings (collectively, the “Services”).

Throughout these Terms, “Barndo Kit Co,” “we,” “us,” and “our” refer to Barndo Kit Co. “You” and “your” refer to any individual or entity accessing or using the Services or purchasing products or services from Barndo Kit Co.

By accessing our website, submitting an inquiry, purchasing a product or service, or otherwise using the Services, you agree to these Terms.

If you do not agree to these Terms, you should not use the Services.

1. About Barndo Kit Co

Barndo Kit Co provides barndominium-related products and services, which may include:

  • Pre-designed barndominium plans.
  • Modified barndominium plans.
  • Fully custom barndominium plans.
  • Mechanical, electrical, and plumbing (“MEP”) design information.
  • Materials estimates and quotes.
  • Barndominium materials kits and build packages.
  • Project guidance and customer support.
  • Related products and services described on our website or in individual proposals, quotes, invoices, purchase agreements, or other written communications.

The exact products and services included in a purchase are determined by the applicable product page, proposal, quote, invoice, purchase agreement, scope of work, or other written agreement between you and Barndo Kit Co.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase products or services from Barndo Kit Co.

If you use the Services on behalf of a company, trust, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

3. Product and Service Information

We make reasonable efforts to accurately describe our plans, materials kits, products, pricing, specifications, timelines, images, renderings, and services.

However, construction products and projects involve variables that may change based on location, design selections, site conditions, code requirements, material availability, manufacturer specifications, engineering requirements, and other circumstances.

Product images, floor plans, photographs, renderings, colors, finishes, and similar visual materials are provided for informational or illustrative purposes unless expressly identified as part of your final approved purchase.

Your specific scope of work and included materials will be determined by your applicable final plans, materials quote, invoice, purchase agreement, or other written order documentation.

4. Pricing

Prices displayed on our website are subject to change unless you have entered into a written agreement or completed a purchase at a stated price.

Materials-kit prices displayed before a final quote may be estimates or starting prices and may vary based on:

  • Building size and configuration.
  • Geographic location.
  • Material selections.
  • Doors and windows.
  • Roof and siding selections.
  • Lumber and commodity pricing.
  • Freight costs.
  • Manufacturer pricing.
  • Design changes.
  • Applicable taxes.
  • Other project-specific requirements.

A website estimate or starting price is not a binding materials-kit quote unless expressly identified as such.

5. Orders and Acceptance

Submitting an order or payment does not require Barndo Kit Co to accept an order if we determine that:

  • Pricing or product information contained an error.
  • A product or service is unavailable.
  • The project falls outside our service area or capabilities.
  • Fraud or unauthorized activity is suspected.
  • Required project information has not been provided.
  • Applicable legal, regulatory, manufacturing, or logistical requirements prevent fulfillment.

If we cannot accept an order after collecting payment, we will address the payment in accordance with the applicable purchase terms and law.

6. Payment

You agree to provide accurate and authorized payment information.

Unless otherwise stated in writing, amounts are due according to the payment schedule shown at checkout, on your invoice, proposal, purchase agreement, or other order documentation.

Materials orders may require full or partial payment before materials are ordered, manufactured, allocated, or shipped.

You are responsible for applicable taxes, governmental charges, and other amounts associated with your purchase unless expressly included in your order.

7. Barndominium Plans

Plans offered by Barndo Kit Co may include as-is plans, modified plans, or fully custom plans.

The applicable product description or written agreement will determine the design services and revisions included with your purchase.

As-Is Plans

An as-is plan is generally provided substantially as displayed or described at the time of purchase.

Unless otherwise stated, revisions or custom design services are not included with an as-is plan.

Modified Plans

Modified plans may allow changes to an existing Barndo Kit Co design subject to the scope and limitations described at the time of purchase.

Fully Custom Plans

Fully custom plans are developed based on project information, preferences, and specifications provided by you.

You are responsible for reviewing design documents and providing accurate and timely feedback.

8. Design Revisions and Approval

Where revisions are included with a plan purchase, we will provide revisions according to the applicable product description or written agreement.

Any representation that revisions are “unlimited” applies only to products expressly advertised as including unlimited revisions and applies during the applicable design process.

Unlimited revisions do not mean that Barndo Kit Co must:

  • Perform work outside the originally purchased scope.
  • Produce multiple unrelated homes or designs from one plan purchase.
  • Continue revisions after final design approval.
  • Perform engineering or other professional services not included in the purchase.
  • Make changes that are unlawful, structurally impractical, or outside our design capabilities.

You are responsible for carefully reviewing your plans before final approval.

Once you approve a design, subsequent changes may result in additional charges, revised estimates, or project delays.

9. Design Satisfaction Guarantee

Certain Barndo Kit Co design products may include a satisfaction or money-back guarantee.

When a guarantee is advertised or offered, its specific terms are governed by the offer, product description, purchase documents, or other written terms applicable when you purchase.

Nothing in these Terms is intended to eliminate or reduce an express money-back or satisfaction guarantee provided by Barndo Kit Co in connection with your purchase.

A guarantee applying during a design process does not necessarily apply to materials that have already been ordered, manufactured, allocated, delivered, or otherwise committed unless expressly stated.

10. Plan Credit Toward Materials

Barndo Kit Co may offer customers a credit for amounts paid toward qualifying plan or design services when the customer later purchases a qualifying materials kit or build package from Barndo Kit Co.

The amount, eligibility requirements, limits, timing, and application of any plan credit are governed by the offer in effect for your purchase and any applicable order documentation.

Plan credits:

  • Have no independent cash value unless expressly stated otherwise.
  • Cannot be sold or transferred to another customer without our written approval.
  • Apply only toward qualifying purchases from Barndo Kit Co.
  • May be subject to eligibility requirements disclosed with the applicable offer.

11. Digital Plan Delivery

Plans and other digital products may be delivered electronically by email, customer portal, download link, or another digital delivery method.

Delivery timelines are estimates unless expressly guaranteed in writing.

You are responsible for maintaining:

  • A functioning email account.
  • Internet access.
  • Appropriate PDF or document-viewing software.
  • Copies or backups of downloaded documents.

We may provide reasonable assistance with problems caused by our delivery system but are not responsible for problems with your personal device, internet connection, software, or storage.

12. License to Use Purchased Plans

Unless otherwise expressly agreed in writing, your purchase of architectural or construction plans provides you with a limited, non-exclusive, non-transferable license to use those plans for the construction of one project for your own use.

Purchasing a plan does not transfer ownership of the plan's underlying copyright, intellectual property, design concepts, drawings, or other proprietary rights.

You may provide copies of purchased plans as reasonably necessary to:

  • Contractors.
  • Subcontractors.
  • Engineers.
  • Architects.
  • Building officials.
  • Lenders.
  • Suppliers.
  • Other professionals directly involved in your project.

You may not, without our written permission:

  • Resell the plans.
  • Publish or commercially distribute the plans.
  • Upload them to plan-sharing websites or public repositories.
  • Provide them to another person for construction of a separate project.
  • Remove copyright or proprietary notices.
  • Represent the plans as your own original work.
  • Reproduce the plans for commercial resale.
  • Use the plans to create substantially identical plans for commercial distribution.

All rights not expressly granted are reserved by Barndo Kit Co and its licensors.

13. Customer-Provided Designs and Materials

If you provide us with floor plans, drawings, photographs, sketches, specifications, inspiration images, or other materials, you represent that you have the right to provide and use them for your project.

You authorize Barndo Kit Co to use those materials as reasonably necessary to perform the Services you requested.

You remain responsible for obtaining any permissions necessary to use third-party copyrighted or proprietary designs.

14. Local Codes, Permits, and Engineering

Building requirements vary significantly by state, county, municipality, and project location.

You are responsible for determining the requirements applicable to your property and project, including:

  • Building codes.
  • Zoning requirements.
  • Setbacks.
  • Permitting.
  • Homeowner-association requirements.
  • Structural engineering.
  • Soil or geotechnical requirements.
  • Foundation requirements.
  • Snow loads.
  • Wind loads.
  • Seismic requirements.
  • Energy codes.
  • Flood requirements.
  • Septic and well requirements.
  • Utility requirements.
  • Professional stamps or seals.
  • Other local requirements.

Plans described as “permit-ready,” “built for permitting,” or similar terminology are intended to provide documentation commonly needed as part of the permitting process. Such terminology does not guarantee that a particular jurisdiction will issue a permit without additional documents, modifications, professional review, engineering, or locally required stamps.

15. Structural Engineering and Professional Services

Unless expressly included in a written agreement, Barndo Kit Co does not provide site-specific structural engineering, geotechnical engineering, surveying, legal services, general contracting services, or other licensed professional services.

Many jurisdictions require plans to be reviewed or stamped by an architect, engineer, or other licensed professional in the state where the building will be constructed.

You are responsible for obtaining such services where required.

MEP layouts or design information provided by Barndo Kit Co do not replace any engineering, trade design, calculations, permits, inspections, or professional services required by local law or your specific project conditions.

16. No Guarantee of Permit Approval

We cannot guarantee approval by a building department, zoning authority, homeowners association, lender, engineer, insurer, or any other third party.

Requirements may differ between jurisdictions and may change over time.

If a reviewing authority requires modifications, additional engineering, or additional documentation, those requirements may result in additional cost or time.

17. Owner-Builder Responsibility

Barndo Kit Co primarily serves customers who may act as owner-builders or otherwise participate in managing their construction projects.

Unless Barndo Kit Co separately enters into a written agreement expressly stating otherwise, Barndo Kit Co is not your general contractor and does not control the construction of your project.

You are responsible for:

  • Hiring and supervising contractors and subcontractors.
  • Confirming appropriate licensing and insurance.
  • Construction methods.
  • Jobsite safety.
  • Construction scheduling.
  • Inspections.
  • Site preparation.
  • Foundations.
  • Labor.
  • Equipment.
  • Installation.
  • Compliance with applicable laws and codes.
  • Determining whether work has been properly completed.

Any guidance provided by Barndo Kit Co is informational and does not create a contractor, architect, engineer, fiduciary, or supervisory relationship unless expressly agreed in writing.

18. Materials Kits and Build Packages

The materials included with a Barndo Kit Co materials kit or build package are determined by your final quote, invoice, purchase agreement, materials list, or other written order documentation.

Do not assume that an item is included solely because it appears in a photograph, rendering, sample plan, advertisement, or another customer's project.

Unless expressly stated otherwise, items such as labor, excavation, grading, utility installation, septic systems, wells, permits, site preparation, specialized equipment, contractor services, engineering, and other work performed at the construction site are not included merely because you purchase a materials kit.

19. Materials Estimates and Field Conditions

Materials are estimated and selected based on the information available when your order is prepared.

Actual construction requirements can be affected by:

  • Field conditions.
  • Installation practices.
  • Design modifications.
  • Waste.
  • Damage.
  • Local code requirements.
  • Contractor preferences.
  • Measurement differences.
  • Site-specific conditions.

You and your contractor are responsible for verifying project conditions and determining whether additional materials are required during construction.

20. Manufacturer and Supplier Products

Some products supplied by Barndo Kit Co are manufactured by independent manufacturers or suppliers.

Manufacturer warranties, where applicable, may govern claims concerning manufacturing defects or product performance.

Barndo Kit Co may assist customers in communicating with manufacturers or suppliers when appropriate, but we do not expand or replace a manufacturer's warranty unless expressly stated in writing.

21. Materials Availability

Construction-material availability and pricing can change because of circumstances outside our control.

These circumstances may include:

  • Manufacturer production schedules.
  • Supply-chain disruptions.
  • Commodity markets.
  • Weather.
  • Transportation delays.
  • Labor disruptions.
  • Product discontinuation.
  • Regional availability.
  • Government action.
  • Natural disasters.
  • Other events beyond our reasonable control.

If an ordered product becomes unavailable, we will work with you as reasonably appropriate to address the situation in accordance with your order documents.

22. Shipping and Delivery

Materials kits may be delivered by third-party freight carriers, manufacturers, or suppliers.

Estimated production, shipping, or delivery dates are estimates unless expressly guaranteed in writing.

Delivery may depend on manufacturing schedules, material availability, freight capacity, weather, site accessibility, and other circumstances outside our control.

You are responsible for providing an accurate delivery address and ensuring the delivery location is reasonably accessible to the required freight vehicles.

Your responsibilities may include:

  • Ensuring adequate road and site access.
  • Providing sufficient unloading space.
  • Providing appropriate unloading equipment.
  • Having appropriate personnel present.
  • Receiving delivery at the scheduled time.
  • Inspecting the shipment when it arrives.

Please also review our Shipping Policy for additional delivery terms.

23. Delivery Inspection and Damage

You should inspect delivered materials carefully when they arrive.

Visible damage, missing items, or discrepancies should be documented promptly, including photographs where appropriate.

When delivery is made by freight carrier, damage should be noted on the delivery documentation before the shipment is accepted whenever reasonably possible.

Failure to timely document freight damage may affect the ability to recover from a carrier, supplier, or manufacturer.

Notify Barndo Kit Co promptly if you discover a delivery problem so we can determine what assistance may be available.

24. Delays

We make reasonable efforts to meet estimated timelines, but construction-related timelines are affected by many factors outside our control.

Except where we have expressly guaranteed a deadline in writing, Barndo Kit Co is not responsible for losses resulting from reasonable delays in:

  • Design.
  • Engineering performed by third parties.
  • Manufacturing.
  • Material availability.
  • Freight transportation.
  • Carrier scheduling.
  • Permitting.
  • Weather.
  • Supplier performance.
  • Events beyond our reasonable control.

You should not schedule contractors or incur time-sensitive expenses based solely on an estimated delivery date unless you have independently accounted for the possibility of delays.

25. Changes After Materials Are Ordered

Changes to a project after materials have been priced, ordered, manufactured, or allocated may result in:

  • Additional charges.
  • Restocking fees.
  • Supplier cancellation charges.
  • Additional freight.
  • New materials requirements.
  • Revised delivery dates.
  • Materials that cannot be returned.

Any requested change is subject to availability and approval.

26. Returns, Refunds, and Cancellations

Refund and cancellation rights vary based on the product purchased and the stage of fulfillment.

Digital plans, custom design services, customized products, specially ordered products, manufactured products, and construction materials may have different cancellation or return restrictions.

Any specific refund, cancellation, or satisfaction guarantee offered with a product is incorporated into these Terms.

Nothing in these Terms eliminates a refund or other remedy required by applicable law.

27. Accuracy of Information You Provide

You agree to provide accurate, current, and complete information relating to your project.

Barndo Kit Co may rely on information you provide regarding matters including:

  • Property location.
  • Dimensions.
  • Project requirements.
  • Desired design.
  • Site conditions.
  • Local requirements.
  • Material selections.
  • Delivery information.

We are not responsible for errors, additional costs, or delays resulting from inaccurate, incomplete, or outdated information supplied by you or your representatives.

28. Website Use

You may use our website only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to our systems.
  • Introduce malware or malicious code.
  • Scrape or systematically copy our website or plan library without authorization.
  • Interfere with website operation.
  • Impersonate another person.
  • Use the Services for fraud or unlawful activity.
  • Circumvent security features.
  • Infringe our intellectual property rights or those of others.

We may restrict access to the Services if we reasonably believe these Terms have been violated.

29. Intellectual Property

Our website and its contents, including:

  • Floor plans.

  • Drawings.
  • Renderings.
  • Photographs.
  • Graphics.

  • Product descriptions.
  • Website design.
  • Marketing materials.

are owned by or licensed to Barndo Kit Co and are protected by applicable intellectual-property laws.

Except for the limited rights expressly granted in connection with a purchased product, no rights are transferred to you.

30. Reviews, Photos, and Customer Content

If you voluntarily submit a review, testimonial, photograph, video, completed-project image, or other content to Barndo Kit Co for publication or promotional use, you represent that you have the right to provide it.

Unless otherwise agreed, you grant Barndo Kit Co a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, and use content you intentionally provide to us for marketing, educational, customer-service, or business purposes.

We will not intentionally use personally sensitive information in marketing without appropriate permission.

31. Third-Party Services and Links

Our website may contain links to or integrations with third-party websites, services, financing providers, manufacturers, social networks, or other businesses.

We do not control and are not responsible for the content, privacy practices, availability, products, services, or policies of third parties.

Your dealings with third parties are governed by the terms applicable to those third parties.

Service providers, aggregators, telecommunications providers, CRM providers, and other vendors may process SMS-related information solely as necessary to operate and support our messaging services.

33. Electronic Communications

By communicating with us electronically, purchasing through our website, or providing an email address or telephone number, you agree that we may communicate with you electronically as permitted by law.

Electronic records, approvals, signatures, and communications may have the same legal effect as paper records where permitted by applicable law.

Your separate consent is required for text messaging where applicable law or industry rules require such consent.

34. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

Please review the Privacy Policy before using the Services.

35. Disclaimer of Warranties

Except for any express warranties or guarantees specifically provided by Barndo Kit Co in writing, and to the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not warrant that:

  • The website will always be uninterrupted or error-free.
  • Every plan will satisfy every local jurisdiction without modification.
  • Every permit will be approved.
  • Construction will achieve a particular cost.
  • A project will qualify for financing.
  • A project will be completed within a particular period.
  • Materials will always be available on a particular date.
  • Information provided by third parties will always be accurate.

Nothing in this section limits an express written warranty, guarantee, or right that cannot lawfully be waived.

36. Construction Risk

Construction inherently involves risk.

Actual costs, schedules, site conditions, contractor performance, permitting requirements, market conditions, financing conditions, and material requirements can differ from initial expectations.

You are responsible for evaluating these risks and engaging appropriate licensed professionals for your project.

37. Limitation of Liability

To the fullest extent permitted by applicable law, Barndo Kit Co will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to the Services, including lost profits, lost opportunities, construction delays, loss of use, or similar damages.

To the fullest extent permitted by applicable law, Barndo Kit Co's aggregate liability arising from a particular product or service will not exceed the amount you paid Barndo Kit Co for the product or service giving rise to the claim.

These limitations do not apply to liability that cannot legally be excluded or limited.

38. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Barndo Kit Co and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your unlawful use of the Services.
  • Your violation of these Terms.
  • Your infringement of another person's rights.
  • Materials or information you provide without authorization.
  • Construction activity that Barndo Kit Co does not control.

This section does not require you to indemnify Barndo Kit Co for liability that applicable law prohibits us from transferring to you.

39. Force Majeure

Barndo Kit Co will not be responsible for failure or delay caused by events beyond our reasonable control, including:

  • Natural disasters.
  • Severe weather.
  • Fire.
  • Flood.
  • War.
  • Terrorism.
  • Civil unrest.
  • Government action.
  • Transportation disruption.
  • Labor disputes.
  • Supply-chain interruption.
  • Material shortages.
  • Manufacturer shutdowns.
  • Utility or communications outages.
  • Epidemics or pandemics.
  • Other comparable events beyond our reasonable control.

We will make commercially reasonable efforts to resume affected performance when reasonably practical.

40. Governing Law

Except where applicable consumer law requires otherwise, these Terms and disputes arising from them will be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

41. Venue

Except where applicable law provides otherwise, any judicial proceeding arising from these Terms or the Services will be brought in a court of competent jurisdiction located in Tennessee.

Nothing in this section prevents either party from bringing a qualifying matter in small claims court or exercising rights that applicable law does not permit these Terms to restrict.

42. Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, business practices, legal requirements, or industry standards.

The revised Terms will become effective when posted unless another effective date is stated.

Changes will not retroactively alter the terms of an already completed purchase where prohibited by law or where separate written purchase terms control.

43. Conflicting Terms

If there is a conflict between these Terms and a separately signed agreement, purchase agreement, proposal, invoice, or other written agreement specifically governing your purchase, the more specific agreement will control regarding the conflicting provision.

44. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

45. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

46. Assignment

You may not assign your rights or obligations under these Terms without our written consent.

Barndo Kit Co may assign its rights and obligations in connection with a merger, acquisition, sale, reorganization, financing, or transfer of all or substantially all of the relevant business or assets, subject to applicable law.

47. Entire Agreement

These Terms, together with our Privacy Policy and any applicable product descriptions, proposals, invoices, purchase agreements, shipping policies, guarantees, or other written terms applicable to your purchase, constitute the agreement between you and Barndo Kit Co concerning the applicable Services.
